Luki Hakim, the Regent of Indramayu, Should Be Dismissed by the Indramayu Regional People’s Representative Council (DPRD)

Many questions have been raised with Lawyer Dudung Badrun’s office about whether Luki Hakim can be retained as the democratically elected Regent of Indramayu.

To answer this question, the Indramayu DPRD provides the following:

First;
Regulations regarding the dismissal of regional heads are contained in Law Number 23 of 2014 concerning Regional Government.
Article 78 outlines three reasons for a regional head to resign: death, resignation, or dismissal.

The focus of the final category is dismissal.
Article 79 details nine grounds for dismissal of a regional head, ranging from the end of the term of office to receiving sanctions for dismissal.

Interestingly, these reasons relate not only to criminal acts but also to ethical violations, administrative violations, and the inability to carry out government functions sustainably.

Some provisions that frequently attract public attention include: violating the oath of office, failing to fulfill obligations as stipulated in Article 67 letter b, violating prohibitions as stipulated in Article 76 paragraph (1), or committing reprehensible acts.

Second;
Facts that have become public knowledge that Luki Hakim has violated his oath of office or violated democracy include:

1. He was sanctioned by the Ministry of Home Affairs for going on vacation to Japan, leaving his duties without the Minister’s permission.

2. False promises, including 17 promises:

a. Making Indramayu religious, but dividing Islamic organizations that should be partners in the planning, implementation, and supervision of building an Indramayu with noble morals.

b. Promising prosperous farmers, but in reality, ignoring their difficulties in eradicating rats and even harassing them by releasing snakes and birds.

c. Violating the duties and functions of the Indramayu Regional Government Work Unit (SKPD) by appointing Salman as a special staff, even though it is illegal.

d. Violating the Spatial Planning Regulation, namely converting a community-owned fishpond area into a fishpond managed by the Ministry of Maritime Affairs and Fisheries without public review and approval from the Indramayu Regional People’s Representative Council (DPRD), as experienced by the fishpond farmers who are members of KOMPI.

e. The holding of the 2025 simultaneous village head elections is a clear violation of the law and the general principles of good governance as stipulated in Law Number 30 of 2014 concerning Government Administration in conjunction with Case Number 247/G/2025/PTUN BDG.

Based on the two reasons above, the Indramayu DPRD has sufficient grounds to pursue an impeachment process against Luki Hakim, the Regent of Indramayu.**
